The terms and conditions apply to users of the Babybay.in website. By using this site, you accept and agree to these terms. We suggest that you carefully read the terms and conditions that are detailed below as this forms the basis of the sale agreement between you and Babybay.in when you purchase goods from our website. If you proceed with your purchase you are acknowledging that you have read and understood these terms and conditions.

Price Promise

If you find a cheaper price on another Online Indian baby retailer, we will endeavour to provide you with a great price. To ensure we can provide you with a great price, simply email wecare@babybay.in with your name, delivery post code, the product you are enquiring about and a link to the store with a cheaper price. The item must be in stock, and be the exact item to which we stock (ie. pack size, colour and supplier stockcode). The Price Promise does not include liquidation, clearance, comparison sale sites, auction or search engine retailers or cannot be used in conjunction with any other offer or promotion. To determine a price match, we may take into consideration the full checkout price including delivery. We reserve the right at any time to not honour a price match.


Payment & Pricing

Payments are processed in real-time, which means, a full payment of your order is required at checkout and funds will be debited immediately. 

All prices are listed in Indian Rupee, The prices indicated exclude delivery and handling. Prices are subject to change without notice. Babybay.in will at all time use our best efforts to ensure that the prices on our website are accurate at any point in time. The prices that are displayed on the website are only current at that particular point in time and we reserve the right to change our prices at any time without prior notice. When price changes occur, they will be automatically updated on the website.

If a price changes on the Babybay.in website before you place your order, Babybay.in at its discretion, reserves the right not to honour this price.

The Babybay.in website prices and offers may vary from in store prices due to website specific sales and promotions.

We accept payment via Visa and MasterCard, including credit cards and debit cards. If placing an order from outside of India, your card may have international purchasing restrictions, simply call your banking institution and advise that you are making a purchase from us. All transactions are secured using 1024 Bit Secure Socket Layer (SSL) Encryption. All transactions are processed by PayU.in and therefore complies with their strict privacy and security policies. No credit card information is shared by this site.
 

Product Availability & Order Process

At Babybay.in, we offer a large range of baby products to our customers. Due to a number of factors (including space, turn over, supplier availability, colourway and more) we do not carry all products advertised on our website. Our checkout will enable you to order a product that is out of stock – this means your Incomplete Order is held in dispatch until the order is Complete.

In the event that you place an order a product that is out of stock in our warehouse, we will endeavour to notify you by email within 2 business days that your order is Incomplete and we will do our best to advise you of an estimated time of arrival for those products out of stock if such information is available. If necessary, we may offer you an alternative item of equal value.

Please ensure you allow enough time for your order to arrive.


Complete Orders

A Complete Order is an order, which has all products within that order ready for dispatch. Please see Delivery Policy for Dispatch & Delivery timeframes.


Incomplete Orders / Backorders / Special Orders

An Incomplete Order, Backorder or Special Order is an order in which one or more items may not be instock at the time of order. We will endeavour to notify you by email within 2 business days that your order is Incomplete. If a product within an order is out of stock, the remaining order will be held in our warehouse until the product arrives in. This includes products that we do not keep instock and are ordered directly through our supplier. This includes but is not limited to furniture and mattress items. Due to size and space requirements, we do not keep all furniture items instock. We advise you to allow up to a 12 week wait for furniture items to arrive from the supplier. Note that an item that is on back order through the supplier generally means longer than average waiting times apply to backorder. Estimated time of arrivals for backorders are approximate only and can change without notice.

Under extreme circumstances and if available, where a delivery of an Incomplete/ Backorder/ Special Order is required (Part Shipment), a delivery fee will be charged. Part Shipments of furniture orders are not available. Please see Delivery Policy for Dispatch & Delivery timeframes.


Delivery Policy

We ship India-Wide excluding some remote locations. Unfortunately, online orders cannot be picked up from warehouse for liability reasons nor can online orders be picked up instore. We ship to residential and business addressed however due to the use of Toll Ipec, we cannot ship to PO Boxes or Parcel Lockers. 


Delivery Costs

To calculate Delivery Costs, simply enter your postcode in the checkout. Delivery costs are influenced by the size and weight of the product and location. Delivery and handling costs are calculated in the shopping cart and will be added to the order total before checkout and cannot be discounted.

If there is any error in delivery charges upon placing your order ie. if your order is of a large cubic weight and needs to be shipped on a pallet, there may be an extra charge payable by you, in which we will advise you of before delivery. You will have the right to cancel your order with no cancellation fee if this is not suitable for you.

Once your order is dispatched, you will receive an automated email from us advising of your tracking number. We cannot guarantee a date or time due to the high volume of deliveries.
 

Delivery Times

Babybay.in will endeavour to process and dispatch Complete Orders from our warehouse within 14 business days, however due to circumstances out of our control this may not occur (ie. If you have purchased Furniture, Backorder or Special Order items).

Delivery times depend on your location within India and with whom your order is shipped through. Delivery addresses outside the metro locations may take longer to deliver depending on the carrier and circumstances.
 

Delivery Tracking

The delivery service of your purchase is determined at the discretion of Babybay.in depending on the size and quantity of products ordered and the address to which the products will be delivered to.


Accepting Deliveries

It is necessary for someone to be available to accept delivery as we use a courier service who requires a signature as proof of receipt. For your convenience and as delivery couriers cannot call prior to delivery, we recommend having your order sent to your work address or to an alternative address if being at home during business hours is not an option.

Furthermore, our couriers use a door-to-door service, which includes delivery to front door, first level entry only. For oversize items, couriers may require assistance unloading heavy and/or bulky items , therefore we ask that someone capable of doing this be present for delivery. Any person present at the delivery address can sign for delivery of the goods.

If no one is available at the delivery address to sign for the delivery, you agree that the contents of that order will be left at the address in an appropriate place. Any redelivery charges are to be paid by the purchaser and not Babybay.in. Please note that if any instance where no one is available at the delivery address, and the goods are left at the premise, that the title to the goods are transferred to you, and any occurrence for damaged, lost or stolen items are not covered and warranty is void. 
 

Products Lost Or Damaged In Transit

Items purchased from Babybay.in online are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon dispatch from the Babybay.in warehouse. Babybay.in takes great care when packaging your order and rarely have our packages been damaged in transit.  We advise for you to inspect all cartons and confirm the contents of all packages at the time of delivery.

If goods appear damaged, we advise for you to not sign for goods, reject the delivery (take photos if possible) and to contact us via email at wecare@babybay.in within 48 hours of attempted delivery for us to help rectify the issue for you.

If goods are signed for at the delivery address, you are therefore are accepting the delivery in good condition and you waiver the right to compensation by Babybay.in, the supplier and the applicable courier service – including but not limited to repair, replacement goods or refunds.

Small items and items that are quantity packed may be repackaged, please don't be worried if your carseat arrives in another box. If you believe you are missing items and have multiple items on your order, ensure you inspect all boxes as generally these will be placed in larger boxes.

In some cases, items may be split during delivery by the couriers and this is out of our control. Generally your other parcels should arrive within 2 business days of your initial delivery. If this does not occur, please contact the courier service with your tracking number prior to contacting us.

If you believe your order has been lost in transit – ie. your tracking number has advised your order has been delivered, please email us at wecare@babybay.in with your concern and order number. We will lodge an investigation on your behalf to the applicable courier service. Investigations usually take up to 2 weeks to finalise, depending on circumstances, some may take longer. Please be advised that Babybay.in cannot redeliver a new order or refund you until the investigation is finalised.

Please note that although we can lodge an investigation on your behalf, Babybay.in are not responsible for compensation to you, of any sort, due to loss of orders or damaged items when goods have been left without a signature.


Product Care Policy

Babybay.in takes pride in supplying quality products. We want you to be completely satisfied with your purchase from Babybay.in online.


Order Cancellations

All order cancellations must be emailed to wecare@babybay.in. Your order is considered current unless cancelled in writing (via email) by you. General Orders incur a 20% cancellation fee, Furniture Orders incur a 50% cancellation fee and Special Orders incur an 80% cancellation fee. Cancellation fees apply to goods only, shipping charges, where applicable will be refunded in full. Orders cannot be cancelled once they have been shipped.

We will cancel, without any cancellation fee, any duplicate order made by you. We must be advised, by you, within 24 hours of the duplicate order being placed and before your order is dispatched from our warehouse.

Order Cancellation credits can only be refunded back to the card issued at checkout. For security reasons, if the card used for the order is no longer in use (expired or cancelled), we will issue you a credit voucher.


Returns

We want you to be completely satisfied with your purchase from Babybay.in online, so if for any reason you wish to return a product to us, we are more than happy to assist you.

To return an item:
1. The item must unused, in its original packaging (packaging must in no way be damaged), hygiene and security seals intact where applicable and be in resalable condition.
2. Include a note advising your reason for return, including a copy of your receipt and a contact email address.
3. Return the item back to us within 7 days of receiving the product, ensuring that the item is packaged so the product is not damaged in transit back to us otherwise a return may be refused. Note that we suggest you return the product by receipted or express post as we cannot be held responsible for any product lost or damaged in transit.
4. Address to: Babybay.in Returns, 2/18, Chinna Venkatasamy St, Sanankuppam, Ambur – 634814, Tamil Nadu. within 7days of receiving the item.
5. The cost of return delivery for the product is your responsibility.
6. Once we receive the returned product, allow 3 business days for us to inspect the product for resale and issue you with an online Credit Voucher number via email to the value of the goods only to use towards a new order – these are valid for 3 months.

Please note that we do not accept returns on Special Orders, personal hygiene products (underwear, swimwear & toiletries), breast pumps, products without security seals (baby wash etc) and car seats. Furniture items incur in a 50% restocking fee. Unfortunately we do not offer refunds due change of mind or incorrectly ordered items.


Incorrect Goods Supplied

In the unlikely event that Babybay.in supplies you with an incorrect product, you must email us with your order number, the product ordered and the product received to wecare@babybay.in, within 48 hours of delivery. We will endeavour to rectify the issue as soon as possible.

To process a return for incorrectly supplied goods:
1. Email us at wecare@babybay.in with your order number, a description of the product you ordered and a description of the product you received.
2. We will advise you by return email what the next step is which is on a case-by-case basis.

Depending on the situation, you may have to send the incorrectly supplied product back to us. We will advise you which method, in which to do so and at our discretion, Babybay.in will reimburse you for the cost of sending the product back to us. Other forms of delivery or upgrade of delivery services, not approved by Babybay.in will be at your cost. The incorrectly supplied product/s must be unused, in its original packaging (packaging must in no way be damaged), hygiene and security seals intact where applicable and be in resalable condition.


Faulty Products

To process a claim for a faulty product:
1. If products are found to be faulty as a result of a manufacturing defect, you must contact us within 48 hours of delivery for us to help rectify the issue for you.
2. The product must not have been used or washed.
3. Email us at wecare@babybay.in, with your order number, a description of the issue, a photo of the faulty product, a photo of the packaging and your complete contact details including contact email. Note that if the product shows damage on the exterior packaging, this is usually due to damage in transit – if the products have been signed for, you are therefore accepting the delivery in good condition and you waiver the right to compensation by Babybay.in, the supplier and the applicable courier service – including but not limited to repair, replacement goods or refunds.
4. We will advise you by return email what the next step is which is on a case-by-case basis.

Babybay.in and its supplier’s reserve the right to assess the condition of the faulty goods prior to offering a repair or replacement. We will do to the best of our ability to advise of the most economical means to have the issue resolved in a timely manner. This may result in the product needing being sent back to us, approved repair agent or supplier for assessment, with all costs for transporting the faulty item for assessment being incurred by you.

If deemed to be a manufacturing fault, the product or part will most likely be repaired or replaced. In the case where a product or part cannot be repaired or replaced, we may offer you a refund on the product or part.


Warranties

All products sold online include a standard warranty, unless otherwise stated. Warranties can vary between 6 months to 5 years depending on the product purchased. Warranties cover for manufacturing faults only and do not cover misuse or wear and tear, please see your product manual for full warranty inclusions as they differ between products.

For a Warranty Claim after the first year of purchase, please contact the supplier directly with your concern.

To process a Warranty Claim within the first year from purchase date:
1. Email us at wecare@babybay.in, with a copy of your receipt, a description of the issue, a photo of the faulty product/issue and your complete contact details including contact email.
2. We will advise you by return email what the next step is which is on a case-by-case basis.

Babybay.in and its supplier’s reserve the right to assess the condition of the faulty goods prior to offering a repair or replacement. We will do to the best of our ability to advise of the most economical means to have the issue resolved in a timely manner. This may result in the product needing being sent back to us, approved repair agent or supplier for assessment, with all costs for transporting the faulty item for assessment being incurred by you.

If deemed to be a valid warranty claim, the product or part will most likely be repaired or replaced. In the case where a product or part cannot be repaired or replaced, we may offer you a refund on the product or part. Please note that there is no warranty included on Gift With Purchases (GWPs) or free products.


Gift Vouchers & Credit Vouchers

Online Gift Vouchers

Online Gift Vouchers are valid for 6 months from the date of issue and must be used prior to the expiry date. Please treat Gift Vouchers as cash as we cannot replace lost or stolen Gift Vouchers. Gift Vouchers cannot be extended past their use by date. Online Gift Vouchers purchased online can only be redeemed online and cannot be redeemed instore. This also means Gift Vouchers purchased instore cannot be used online. Should you wish to purchase a Gift Voucher to be redeemed instore, please contact your local Babybay.in store.

Online Gift Vouchers must be used in one transaction only and cannot be split. Please note, if you proceed to checkout and enter your Gift Voucher and do not proceed with the order, your voucher will be deemed used. Change cannot be given should the purchase amount be lesser than the value of the online Gift Voucher.

Delivery for Gift Vouchers is approximately 1 to 6 working days. Gift Vouchers are delivered free of charge and is for standard India courier only. Where applicable, Gift Vouchers do not cover the cost of Delivery. Promotional discounts and codes cannot be used when purchasing a Gift Voucher.

Online Credit Vouchers

Credit Vouchers are given for returned products and must be used within 3 months of being issued and must be used prior to the expiry date. Please treat Credit Vouchers as cash as we cannot replace lost or stolen Credit Vouchers. Credit Vouchers cannot be extended past their use by date. 

Online Credit Vouchers must be used in one transaction only and cannot be split. Please note, if you proceed to checkout and enter your Credit Voucher and do not proceed with the order, your voucher will be deemed used.
